13th Month Pay Computation in the Philippines: 2026 Guide

By Robin Salvador, co-founder, Caffeine Brothers
Last updated: October 22, 2026

Quick answer: 13th month pay is at least one-twelfth of the total basic salary a rank-and-file employee earned during the calendar year, paid on or before December 24 (Presidential Decree No. 851). Add up the basic pay actually earned from January to December and divide by 12. For a Metro Manila minimum wage worker on a six-day week, the wage hike of September 26, 2026 makes this year’s amount ₱18,542.92 instead of ₱18,127.92.

Key takeaways

  • The formula is total basic salary earned in the year ÷ 12. Overtime, holiday pay, night differential, COLA, converted leave and commissions are left out unless company policy treats them as basic pay.
  • Every rank-and-file employee who worked at least one month in the year is covered, whatever their status or how they are paid. Managers are not covered by the law.
  • The deadline is December 24, 2026. Half may be paid before the school year opens. DOLE allows no exemption or deferment.
  • At NCR-28 rates, a full-year 2026 amount is ₱18,542.92 at the ₱695 to ₱755 non-agriculture rate and ₱17,577.83 at the ₱658 to ₱718 rate.
  • Up to ₱90,000 of 13th month pay and other bonuses is tax-exempt. Proposals to raise it to ₱120,000 or ₱150,000 were still pending on October 22, 2026.

We supply coffee to offices and cafés, and every November the same payroll questions come up from the HR teams we deliver to. This guide follows the text of PD 851 and the Department of Labor and Employment (DOLE) handbook, with worked numbers at the current Metro Manila minimum wage. It is a plain-language summary and not legal or tax advice. For a specific case, ask DOLE, the BIR or your payroll adviser.

What is 13th month pay?

Presidential Decree No. 851, signed on December 16, 1975, requires employers to pay a 13th month pay “not later than December 24 of every year.” The original decree covered only employees earning up to ₱1,000 a month. The decree has since been amended (the TRAIN law refers to PD 851 “as amended by Memorandum Order No. 28, dated August 13, 1986”), and DOLE now applies the benefit to all rank-and-file employees in the private sector with no salary ceiling.

DOLE’s 2023 handbook defines it as “one-twelfth of the total basic salary earned by an employee within a calendar” year. It is a minimum. An employer can pay more, and a Christmas bonus or mid-year bonus can count as “its equivalent” if it is at least one-twelfth of basic salary. If the bonus is smaller, the employer pays the difference.

Who is entitled to 13th month pay?

All rank-and-file employees are entitled, “regardless of the nature of their employment and irrespective of the methods by which their wages are paid, provided they worked for at least one (1) month during a calendar year,” in the handbook’s words. That includes probationary, contractual, part-time and piece-rate workers. Someone with two private employers gets 13th month pay from both.

Managerial employees are not covered by the law, although many companies pay them anyway. The handbook also lists employers outside PD 851: the government (except corporations run as private subsidiaries), employers of household helpers, employers already paying a 13th month or its equivalent when the decree was issued, and employers of workers paid purely on commission, boundary or task basis. Piece-rate workers stay covered.

What counts as basic salary?

This is where most computation mistakes happen. Basic salary is what the employee earns for normal work. Premiums and allowances on top of it are left out unless the company has folded them into basic pay by contract, policy or practice.

How do you compute 13th month pay?

  1. List the basic salary earned each month from January 1 to December 31, or from the start date if the employee joined during the year.
  2. Deduct unpaid absences and leave out overtime, premiums, night differential, allowances and commissions.
  3. Add the twelve months to get total basic salary earned.
  4. Divide by 12. The result is the minimum 13th month pay.
  5. Subtract any amount already paid, such as a half released in June, and pay the balance on or before December 24.

For daily-paid staff, DOLE’s handbook converts a daily rate into a monthly equivalent with a factor of 313 days a year for a six-day workweek. Its 2023 illustration uses ₱570 a day for January to mid-July and ₱610 for the rest of the year, showing how to handle a wage order that lands mid-year. We used the same method for 2026.

How much is 13th month pay for minimum wage earners in NCR in 2026?

Wage Order NCR-28 raised the Metro Manila minimum by ₱60 on September 26, 2026: from ₱695 to ₱755 a day for non-agriculture workers, and from ₱658 to ₱718 for agriculture, retail and service establishments with 15 or fewer workers and small manufacturers. In 2026 a six-day week has 230 working days from January 1 to September 25 and 83 from September 26 to December 31, which add up to the handbook’s 313.

Bar chart of 2026 13th month pay for NCR minimum wage earners on a six-day week with 313 paid days. Non-agriculture: full year at ₱695 would be ₱18,127.92; 2026 actual with 230 days at ₱695 and 83 days at ₱755 is ₱18,542.92; full year at ₱755 is ₱19,692.92. Retail and service with 15 or fewer workers: ₱17,162.83 at ₱658, ₱17,577.83 for 2026 actual, ₱18,727.83 at ₱718.
2026 13th month pay at the NCR minimum wage, six-day week, no unpaid absences. Sources: DOLE BWC handbook 2023; GMA News, September 26, 2026. Calculation: Caffeine Brothers.

For a non-agriculture worker with no unpaid absences, that is (230 × ₱695) + (83 × ₱755) = ₱222,515 of basic pay, and ₱222,515 ÷ 12 = ₱18,542.92. At the lower rate it is (230 × ₱658) + (83 × ₱718) = ₱210,934, or ₱17,577.83. The wage hike adds ₱415 to this year’s 13th month pay in both cases. A worker with a full year at the new rates in 2027 would receive ₱19,692.92 or ₱18,727.83, if no other wage order takes effect.

Overtime and night premiums do not change any of these results. A barista who earns ₱3,000 of night differential over the year, as covered in our night shift differential guide, still gets 13th month pay on the base wage only, unless the employer has made the premium part of basic pay. For a full picture of what a minimum wage staff member costs per month, including the 13th month accrual, see our barista salary breakdown.

When must 13th month pay be released?

The legal deadline is December 24. For 2026 that falls on a Thursday. The handbook allows the employer to pay one-half “before the opening of the regular school year and the remaining half on or before December 24,” and a union-represented workplace can agree on a different schedule. DOLE does not accept requests to skip or defer it. Labor Advisory No. 16, Series of 2025 repeated that there are no exemptions.

After paying, employers file a compliance report online at reports.dole.gov.ph. For the 2025 payout the deadline was January 15, 2026, set in the same advisory. PD 851’s implementing rules have used January 15 of the following year since 1975, so plan for January 15, 2027 unless DOLE announces otherwise. Unpaid 13th month pay is handled as a money claim.

Is 13th month pay taxable?

Up to ₱90,000 a year is excluded from gross income under Republic Act No. 10963 (TRAIN). The ceiling covers the 13th month pay and other benefits together, such as a Christmas bonus or productivity incentive. The 13th month pay also does not count as regular wage for SSS, PhilHealth, State Insurance Fund contributions or overtime computations, according to the handbook.

Effect of the ₱90,000 ceiling under RA 10963, as of October 22, 2026. Salaries are examples. Actual tax on the excess depends on the employee’s bracket.

Several proposals to raise the ceiling were filed in 2026. The House Committee on Ways and Means chair proposed ₱120,000 (Politiko, July 31, 2026). Senate Bill 56 proposes ₱150,000, and its author urged immediate passage on October 5, 2026 (The Manila Times). House Bill No. 10345, which raises the general income tax exemption, was still at committee level as of BusinessWorld’s October 1 report. None of these was law on October 22, 2026, so this year’s payroll should use ₱90,000. Non-cash Christmas gifts follow separate de minimis rules, which we cover in our Christmas gift tax exemption guide.

Common 13th month pay mistakes

  • Including overtime and holiday premiums in the base, which overpays, or excluding paid leave days, which underpays.
  • Forgetting staff who resigned during the year. Their pro-rated share is due too.
  • Treating a small Christmas bonus as a replacement. It only counts as the equivalent if it reaches one-twelfth of basic salary.
  • Using the new wage rate for the whole year, or the old rate for the whole year, when a wage order took effect mid-year.
  • Missing the January compliance report after paying on time.

Frequently asked questions
