Final Pay Computation in the Philippines: Rules and Examples
By Robin Salvador, co-founder, Caffeine Brothers

Quick answer: Final pay is the total of all wages and benefits an employer still owes a worker who leaves, whatever the reason for leaving. It usually includes unpaid salary up to the last day, pro-rated 13th month pay, the cash value of unused service incentive leave, and separation pay when the exit is for an authorized cause such as retrenchment or redundancy. Under DOLE Labor Advisory No. 06, Series of 2020, it must be released within 30 days of separation unless a company policy is more favorable. For a Metro Manila café crew member on the ₱718 daily minimum who resigns on October 31, 2026, our worked example comes to ₱27,510.17.
Key takeaways
- DOLE Labor Advisory No. 06, Series of 2020 (January 31, 2020) sets the release of final pay within 30 days from separation and the issuance of a certificate of employment within 3 days of the request.
- Pro-rated 13th month pay is one twelfth of the basic salary earned from January 1 to the last day of work (DOLE handbook, 2023 edition).
- Separation pay is half a month per year of service for retrenchment or closure not due to serious losses, and one month per year for redundancy or labor-saving devices, with a fraction of at least six months counted as one year.
- At the NCR-28 rate of ₱718 a day (effective September 26, 2026), our example worker’s final pay is ₱27,510.17 on resignation, ₱55,601.92 on retrenchment and ₱83,693.67 on redundancy.
- DOLE’s 1349 hotline logged 23,496 final pay reports in 2025, the top labor concern among 168,853 inquiries (Manila Bulletin, January 22, 2026).
Year-end is when many café crew, baristas and office staff move on, and owners ask us how to settle what they still owe. This guide reads DOLE’s labor advisory on final pay, the 2023 DOLE handbook on statutory benefits, the leading Supreme Court case on clearance and the current Metro Manila wage order, then works through one example in pesos. It is a plain-language summary and not legal advice. For a specific case, ask your DOLE field office or a labor lawyer.
What is final pay?
Final pay, also called last pay or back pay in everyday HR talk, is the sum of all wages and monetary benefits due to an employee when the job ends. It applies whether the employee resigned, was dismissed for a just cause, or was separated for an authorized cause. The reason for leaving changes what goes into the total, mainly whether separation pay is owed, but it does not remove the obligation to pay what was already earned.
DOLE put a deadline on this in Labor Advisory No. 06, Series of 2020, issued January 31, 2020. Before that advisory there was no fixed period, as Dean Nilo Divina noted in his Daily Tribune column of April 23, 2026. DOLE repeated the rules on January 22, 2026, when it said withholding final pay or a certificate of employment is unlawful and that its 1349 hotline had received 168,853 inquiries nationwide, with final pay the top concern at 23,496 reports.

The advisory and DOLE’s 2026 reminder list the same items. Not every item applies to every worker, so check each line against the employee’s contract, payslips and company policy.
| Item | Rule | Where it comes from |
|---|---|---|
| Unpaid salary | Pay for days worked since the last payroll cutoff, at the current rate | Labor Advisory 06-2020; DOLE reminder, Jan 22, 2026 |
| Pro-rated 13th month pay | 1/12 of total basic salary earned from January 1 to the last day of work | PD 851; DOLE handbook 2023, section on resigned or separated employees |
| Unused service incentive leave | Cash value of unused SIL at the salary rate on the date of conversion; may be pro-rated | Labor Code Art. 95; DOLE handbook 2023 |
| Separation pay | Only for authorized causes, or if a contract or policy grants it | Labor Code Arts. 298 and 299; DOLE handbook 2023 |
| Retirement pay | If the employee retires under Art. 302 or a retirement plan | DOLE reminder, Jan 22, 2026 |
| Tax refund | Any excess tax withheld during the year | Labor Advisory 06-2020 summaries; DOLE reminder |
| Other benefits | Unused vacation leave, bonuses or other items promised by policy, contract or CBA | Labor Advisory 06-2020; DOLE reminder |
Final pay is a gross figure. The usual payroll deductions for the last cutoff, and any amounts the employee already owes the company, come off before the net amount is released.
How do you compute each part of final pay?
Unpaid salary
Count the days worked from the last payroll cutoff to the last day of work and multiply by the daily rate in force. For a daily-paid worker in Metro Manila, Wage Order NCR-28 raised the minimum to ₱755 a day for non-agriculture and ₱718 a day for retail and service establishments with 15 or fewer workers, effective September 26, 2026 (GMA News). The old rates were ₱695 and ₱658.
Pro-rated 13th month pay
DOLE’s handbook says an employee who resigns or is separated before the 13th month payout is entitled to it “in proportion to the length of time” worked during the year. The amount is one twelfth of the total basic salary earned from January 1 up to the last day. If the rate changed during the year, add up what was actually earned at each rate. Our 13th month pay computation guide covers the inclusions and exclusions in detail.
Unused service incentive leave
Covered employees earn five days of service incentive leave after a year of service. The handbook says unused days that were not converted are paid on resignation or separation, at the salary rate on the date of conversion, and that use and conversion may be pro-rated. Its own illustration gives an employee hired January 1, 2022 who resigned March 1, 2023 a total of 5.833 days. Establishments regularly employing fewer than ten workers are exempt. See our service incentive leave guide for the full list of exclusions.
Separation pay
Separation pay depends on why the job ended. The handbook bases it on the latest salary rate and says regular allowances should be included in the salary base, citing Planters Products v. NLRC (1989).
| Reason for separation | Separation pay | Minimum |
|---|---|---|
| Resignation | None under the Labor Code (unless a contract or policy grants it) | None |
| Dismissal for a just cause | None under the Labor Code | None |
| Retrenchment to prevent losses | 1/2 month pay per year of service | 1 month pay |
| Closure not due to serious losses | 1/2 month pay per year of service | 1 month pay |
| Disease not curable within 6 months | 1/2 month pay per year of service | 1 month pay |
| Redundancy | 1 month pay per year of service | 1 month pay |
| Installation of labor-saving devices | 1 month pay per year of service | 1 month pay |
| Closure due to serious losses | None under the handbook’s list | None |
For authorized causes the employer must also give written notice to the employee and to the DOLE regional office at least one month before the separation date, either through RKS Form 5 or the online DOLE Establishment Report System.
Worked example: a café crew member at ₱718 a day
Here is one case worked line by line. The numbers are our own calculation from the rules above. We assume a crew member at a Metro Manila café with 12 employees, paid ₱718 a day (₱658 before September 26), working Monday to Saturday, hired March 1, 2024, with a last day of October 31, 2026. We assume she was paid for every Monday to Saturday in 2026 with no unpaid absences, that her last payroll covered work up to October 15, that her 2025 leave was used or converted in December 2025, and that she used no leave in 2026.
| Line | Computation | Amount |
|---|---|---|
| Unpaid salary, Oct 16 to 31 | 14 working days × ₱718 | ₱10,052.00 |
| Basic salary earned in 2026 | 230 days × ₱658 (Jan 1 to Sep 25) + 31 days × ₱718 (Sep 26 to Oct 31) = ₱173,598 | not paid again |
| Pro-rated 13th month pay | ₱173,598 ÷ 12 | ₱14,466.50 |
| Unused 2026 service incentive leave | 5 days × 10/12 = 4.167 days × ₱718 | ₱2,991.67 |
| Final pay if she resigns | Sum of the three lines above | ₱27,510.17 |
| Monthly pay used for separation pay | ₱718 × 313 ÷ 12 (DOLE handbook factor for Monday to Saturday workers) | ₱18,727.83 |
| Years of service | 2 years 8 months; 8 months is at least 6, so 3 years | 3 |
| Separation pay, retrenchment | 1/2 × ₱18,727.83 × 3 | ₱28,091.75 |
| Final pay if retrenched | ₱27,510.17 + ₱28,091.75 | ₱55,601.92 |
| Separation pay, redundancy | 1 × ₱18,727.83 × 3 | ₱56,183.50 |
| Final pay if made redundant | ₱27,510.17 + ₱56,183.50 | ₱83,693.67 |

Using the ₱755 non-agriculture rate instead (₱695 before September 26), the same worker’s pro-rated 13th month would be ₱15,271.25, the 14 unpaid days ₱10,570.00, the leave ₱3,145.83 and the monthly pay for separation purposes ₱19,692.92.
When must final pay and the certificate of employment be released?
Final pay is due within 30 days from the date of separation or termination, unless a more favorable company policy or an individual or collective agreement says otherwise. A certificate of employment must be issued within three days of the employee’s request. It states the employee’s dates of employment and the type of work done, and it is due whatever the reason for leaving.
- Last day October 31, 2026: final pay due on or before November 30, 2026.
- Last day November 15, 2026: due on or before December 15, 2026.
- Last day December 31, 2026: due on or before January 30, 2027.
If the employee left before the regular 13th month payout, the pro-rated amount goes into final pay. Separation pay due to death, sickness, physical disability or another cause beyond the employee’s control is excluded from gross income under Section 32(B)(6)(b) of the Tax Code, as the DOLE handbook notes. The 13th month pay and other benefits are tax-free up to ₱90,000 a year under Section 32(B)(7)(e) of the Tax Code as amended by the TRAIN law (RA 10963).
Can an employer withhold final pay for clearance?
Clearance is allowed, within limits. In Milan v. NLRC (G.R. No. 202961, February 4, 2015), the Supreme Court called clearance before the release of last payments a standard procedure among employers and allowed the release of benefits to be conditioned on the return of company property, on the principle against unjust enrichment. The case does not let an employer cancel benefits that are already due. As Dean Divina wrote, the 30-day period works best as a shared responsibility: the employee completes clearance promptly and the employer acts quickly once it is done.
Disputes over final pay or the certificate of employment go to the DOLE regional, provincial or field office that covers the workplace. Workers can also call the 1349 hotline, which DOLE says runs weekdays from 6 a.m. to 10 p.m.
A six-step checklist for settling final pay
- Confirm the last day and the reason for leaving in writing, because the reason decides whether separation pay is owed.
- Start clearance on the first day of notice so property returns and cash advances are settled before the 30-day deadline.
- Compute unpaid salary from the last cutoff to the last day at the current rate, including any premiums for days already worked.
- Add the pro-rated 13th month from the basic salary actually earned since January 1, at each rate that applied.
- Add leave and separation pay that apply, using the latest salary rate and regular allowances.
- Release the money and the certificate within 30 days of separation, issue the certificate within 3 days of the request, and keep a signed computation sheet.

Frequently asked questions
How many days does an employer have to release final pay?
Under DOLE Labor Advisory No. 06, Series of 2020, final pay is released within 30 days from the date of separation or termination, unless a company policy or an individual or collective agreement gives a shorter period. For an employee whose last day is October 31, 2026, that means on or before November 30, 2026.
Is separation pay part of final pay when an employee resigns?
No, not under the Labor Code. Separation pay is due for authorized causes such as retrenchment, closure not due to serious losses, redundancy or the installation of labor-saving devices. An employee who resigns gets separation pay only if a contract, company policy or collective agreement grants it.
Can an employer hold final pay until clearance is done?
Yes, within reason. In Milan v. NLRC (G.R. No. 202961, February 4, 2015), the Supreme Court said requiring clearance before the release of last payments is a standard procedure and that an employer may withhold amounts to cover accountabilities that are already due, such as unreturned company property.
How is the pro-rated 13th month pay in final pay computed?
It is one twelfth of the total basic salary the employee earned from January 1 up to the last day of work. Basic salary excludes overtime, holiday and night shift premiums unless they are already part of the basic pay by agreement or practice.
How fast must a certificate of employment be issued?
Within three days from the employee’s request. The certificate states the dates of employment and the type of work the employee did.
